Minimum Service Levels To Be Judicially Reviewed

The Public and Commercial Services Union (PCS) has won permission to have minimum service levels in relation to Border Force judicially reviewed. The Strikes (Minimum Service Levels) Act 2023 imposes a requirement to provide minimum service levels during a strike. Minimum service levels have since been enacted in relation to border force staff, ambulance service personnel, rail workers, and fire and rescue services. However, the PCS argue that this legislation breaches Article 11 of the European Convention on Human Rights, which protects the right to not only form / join trade unions, but also to strike / take industrial action.
