Accountants & Actuaries

We handle regulatory cases where accountants and actuaries are being investigated by the Institute of Chartered Accountants in England and Wales (ICAEW), the Chartered Institute of Public Finance and Accountancy (CIPFA), the Association of Chartered Certified Accountants (ACCA), the Chartered Institute of Management Accountants (CIMA), and the Institute and Faculty of Actuaries (IFoA).

In the United Kingdom, accountants and actuaries are regulated both by their individual professional bodies and, in certain public interest cases, by the Financial Reporting Council (FRC). The FRC is responsible for overseeing investigations and enforcement in serious cases involving matters of public interest, while other disciplinary matters are generally dealt with by the relevant professional body. Cases may be referred to the FRC by the professional bodies, or the FRC may begin investigations on its own initiative where appropriate.

Where a concern is raised, the matter will first be assessed to determine whether it falls within the jurisdiction of the relevant professional body or the FRC. If the case proceeds, an investigation will be carried out, following which a decision is made as to whether disciplinary proceedings should be commenced. Where formal proceedings are brought, the matter may be referred to an independent disciplinary tribunal or panel, at which the accountant or actuary is entitled to make representations, call witnesses, and submit evidence in their defence.

If misconduct is proved, sanctions may include reprimands, fines, conditions on practice or membership, suspension, or expulsion from membership of the relevant professional body. Decisions may generally be appealed in accordance with the appeal procedures of the relevant regulator or tribunal.
