Claimant wins constructive dismissal case after Respondent withheld his salary on account of a dispute over unpaid rent with the Claimant's wife's employer, on a property owned by the Respondent. ET hold that: "By failing to pay the Claimant..., the Respondent was in breach of contract. The agreement to be paid is a fundamental term of any employment contract.....The failure to adhere to the obligation is therefore a fundamental breach of contract, for which the Claimant would be entitled to resign and claim constructive dismissal."
