The new statutory code of practice on dismissal and re-engagement (aka 'fire & rehire') formally came into force with effect from the 18th July 2024. This means that employment tribunals can now apply up to a 25% uplift upon compensation awards where employers have been found not to have adhered to the code of practice
Nevertheless, as we highlighted in a recent article, the Labour Government are planning to replace the code of practice and ban ‘fire and rehire’ except where there is no other viable option to ensure the survival of the business and where a proper procedure has been followed.
