Employment (Allocation of Tips) Act 2023 Comes Into Force

The Employment (Allocation of Tips) Act 2023 came into force on the 1st October 2024. Under the legislation, workers will be legally entitled to receive tips, gratuities, and service charges in full without deductions, and will be entiled to pursue a claim in the employment tribunal where their employer is in breach of their statutory obligation to pass them on to them.

The statutory code of practice was published on the 29th July 2024.

The Parliamentary Under-Secretary of State for Employment Rights, Competition and Markets, Justin Madders, stated: "This is just the first step of many in protecting workers and placing them at the heart of our economy. We will be introducing further measures on tipping to ensure workers get their fair share of tips." These "further measures" on tips may be included in the Employment Rights Bill, which is due to be published and laid before Parliament by no later than the 12th October 2024, the most likely date being the 10th October 2024.
