EAT Orders Reconsideration Of Anonymity Order And Restricted Reporting Order (RRO)

The EAT handed down judgment in the case of A v (1) B (Organisation) (2) C (3) D [2026] EAT 35 on 4 March 2026. The case concerned an Anonymity Order and Restricted Reporting Order (RRO) originally granted by the Employment Tribunal in August 2023, which prevented identification of the respondent organisation (“B”) and two individual respondents (“C” and “D”) due to security concerns and the risk of “jigsaw identification.” The claimant challenged the scope of the order on the basis that it infringed the principle of open justice and Article 10 ECHR. Although the EAT had previously upheld the order in [2025] EAT 167, Judge Tayler accepted on review that the earlier judgment had failed to address material submissions on freedom of expression and ordered reconsideration of the balance between privacy protections and open justice.
