The Government has published its response to the consultation on the issue of the draft statutory code of practice on dismissal and re-engagement (aka 'fire and rehire') which has now been laid before parliament, with a view to it coming into force in summer 2024. Once in force, employment tribunals will have the power to "increase any award it makes by up to 25% if the employer has unreasonably failed to comply with the Code" and vice versa. The draft code had originally been published in January 2023, ahead of the launch of the consultation on the issue.
