Restrictive covenants in the employment context are essentially obligations upon the employee towards the employer to refrain from particular activities once they have ceased working for the employer. The most common are:-

  • Confidentiality re employers business affairs

     

  • Not to compete with the employer in certain ways and/or in certain areas for a specific period

     

  • Not to recruit employees of the employer for a specific period

     

  • Not to approach or deal with customers of the employee

 

The restrictions imposed must be reasonable otherwise the employer runs the risk of them being struck out as an unfair restraint of trade.
